We strongly condemn any form of interaction between users outside of the Platform. Any information you choose to share remains your sole responsibility and is done at your own risk. Use of the Platform for the purpose of engaging in unlawful or illegal activities, including, but not limited to, prostitution or the selling of sex, is prohibited. You agree to take all necessary precautions when interacting online with other users, including sellers. You also understand that, other than the sex offender registry review described in the Terms for Sellers, if applicable based on country of residence, we do not carry out any background or any kind of criminal record check on our users and thus we make no statement or warranty regarding our users’ behavior. Therefore, you agree to remain vigilant and take all necessary precautions when interacting with other users, including sellers, on the Platform.

Purchases
5.1. LinkPay’s Role. All transactions and interactions facilitated by LinkPay are contracts between buyers and sellers. Although we facilitate such transactions and interactions by providing the Platform, storing Content and acting as an intermediary, we are not a party to any transactions, interactions, contracts or any other agreements between you and a seller and, therefore, are not responsible for any transactions or interactions between buyers and sellers. LinkPay does not issue credits, refunds, or cashback on Content purchased by buyers, unless a Video Call or a Custom Request is cancelled by the seller, in the circumstances set out in the Refunds and Disputes Policy. Please refer to our Payment Terms and Refunds and Disputes Policy for additional information.
5.2. Price Determinations. Sellers are solely responsible for determining (within the parameters of our Payment Terms) the pricing of all Premium Activities Published to the seller’s profile. All prices will be listed on the Platform in US Dollars or in your local currency, as applicable.

Any user who has not yet set up a Buyer Account will be prompted to create a Buyer Account prior to inputting any payment card or other billing details.
5.3.2. You authorize us to supply your payment card details to a third-party payment provider for the purpose of processing your Buyer Payments. All Buyer Payments will be charged in US Dollars or in your local currency, as applicable; provided, however, that your payment card provider may charge you currency conversion fees. We do not have control over currency exchange rates or charges imposed by your payment card provider or bank and we are not responsible for paying any charges or fees imposed by your payment card provider or bank.

6.3. Fees & Rates. We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Part 2: When these Terms apply
PART 2 – TERMS FOR BUYERS FROM OUTSIDE THE US OR CANADA
7.1. LinkPay operates a platform, which we make available as a service through a web application available at linkpay.co, that allows content creators (“sellers”) to upload and share pictures, videos and other content (the “Content”) and allows users to view and purchase such Content (the “Platform”).
7.2. In order to access certain Content and use certain functionalities of the Platform, such as purchasing Content from sellers, booking Video Calls with sellers and being identified in Content uploaded by sellers (collectively, “Buyer Features”), you will need to sign up to become a buyer on the Platform and create an account (your “Buyer Account”).
7.3. These “Terms for Buyers” set out additional terms that apply to you when you create a Buyer Account and use the Buyer Features.
7.4. These Terms for Buyers form part of our Terms of Use and apply to you if you are accessing the Buyer Features from outside the United States or Canada. If you are in the United States or Canada, please read Part 1 (Sections 1 to 6), which applies to you when you create a Buyer Account and use the Buyer Features.
7.5. Please read these Terms for Buyers carefully to ensure that you understand them before creating a Buyer Account and becoming a buyer.
7.6. We will ask you to agree to these Terms for Buyers when you create a Buyer Account. If you do not agree to these Terms for Buyers, you must not create a Buyer Account on the Platform.
Part 2: Information about us
8.1. The Platform is provided by Boink Technologies, Inc., a Delaware corporation (“LinkPay”, “we”, “our”, or “us”), a company registered in Delaware, United States of America.
8.2. If you would like to get in touch with us, you can write to us:
- by email to support@linkpay.co;
- by post to Boink Technologies, Inc., a Delaware corporation, 2045 Biscayne Blvd. Suite 118, Miami, FL 33137.
Part 2: Information about you
9.1. Your privacy is important to us. Please read our Privacy Notice to understand how we collect, use and disclose information about you.
Part 2: Important Warnings
10.1. We do not create Content; any Content made available through the Platform is provided by sellers. When you purchase Content from a seller, you enter into a direct agreement with that seller. While we do our best to ensure that we only work with verified sellers that have gone through a vetting process, the seller ultimately determines what Content the seller posts to the Platform (if any). Sellers, and not us, are responsible for ensuring that the Content you purchase is of satisfactory quality and matches any descriptions provided by that seller.
10.2. Your Buyer Account is linked to your mobile phone number or email address. In order to authenticate you and allow you to access your Buyer Account, we will send a one-time password to the mobile phone number or email address associated with your Buyer Account each time you log in to your Buyer Account. If you change your mobile phone number, if your mobile phone is lost or stolen, or if your email account is compromised, you must ensure that you update the contact details associated with your Buyer Account. You will lose access to your Buyer Account if you are unable to access the mobile phone or email associated with your Buyer Account, and a third party may gain access to your Buyer Account if your mobile phone is stolen or your email account compromised. We will not be responsible to you for any losses that you suffer as a result, unless we fail to implement any updates to your contact details requested by you in a timely manner.
Part 2: Creating a Buyer Account
11.1. To become a buyer, you must be eligible to use the Platform in accordance with the Terms of Use, including as follows:
- you must be at least 18 years or older and capable in your country of residence of entering into a legally binding agreement; and
- you must not have been previously banned by us from using the Platform.
11.2. You can create a Buyer Account using the applicable functionalities on the Platform. When you create a Buyer Account, you will need to:
- provide your mobile phone number or your email address;
- confirm that you are at least 18 years old; and
- agree to these Terms for Buyers.
11.3. We will use the contact details associated with your Buyer Account to send you one-time passwords to authenticate you and allow you to access your Buyer Account, as well as for Buyer Account recovery. You should therefore ensure that any details you provide when creating a Buyer Account are accurate, and that you keep the information associated with your Buyer Account up to date, as we will not be responsible to you for any delays or failure to access or recover your Buyer Account if you fail to provide accurate details or keep your information up to date.
11.4. You should immediately update your details if your phone is lost or stolen, or if you believe that your email account is compromised. A third party with access to your phone or email account may be able to access your Buyer Account, and we will not be responsible to you for any losses you suffer as a result unless this is as a result of our failure to implement any changes to your account details in a timely manner.
Part 2: Video Calls
12.1. We may, as part of the Buyer Features, allow you to engage with sellers through live one-to-one video calls on the Platform (“Video Calls”).
12.2. You must ensure that your use of Video Calls, including any images, text or information that you display or upload to the Platform when you use Video Calls, complies with our Acceptable Use Policy.
12.3. We may record Video Calls and review them to ensure they comply with our Acceptable Use Policy. If you believe that any Video Call you engage in with a seller violates our Acceptable Use Policy, please notify us in accordance with Content Moderation, Reporting and Removal.
12.4. Any recordings of Video Calls that we make will belong to us.
12.5. Our ownership of the recordings we make of Video Calls does not in any way affect your privacy rights or any rights you have in your image or likeness. Please see our Privacy Notice which provides information on how we collect, use and disclose information about you.
Part 2: Purchases
13.1. We do not charge you a fee to access the Platform. However, sellers may:
- make access to certain Content available for one-off purchase;
- offer for purchase the opportunity to engage with you in Video Calls; and
- offer to create Content to your commission as a Custom Request,
(collectively, the “Paid Features”).
13.2. If you purchase Paid Features, we will collect the purchase price in respect of that Paid Feature (the “Purchase Price”) from you on behalf of the relevant seller.
13.3. You can also send monetary one-off “tips” to sellers in the amount selected by you, using the applicable functionalities of the Platform (“Tips”).
Part 2: Making Payments
14.1. In order to purchase Paid Features or give a Tip (“Premium Activities”), you will need to provide details of a valid payment method.
14.2. We will ask you to provide details of a valid payment method when you first purchase a Premium Activity. The payment methods that we accept will be displayed to you on the payments page on the Platform.
14.3. We may refuse to process any payment that you make from a card that is not in your name.
14.4. By proceeding with a purchase of any Premium Activities, you authorize us to charge, on behalf of the seller, the relevant Buyer Payment amount to your chosen payment method.
Part 2: Purchasing Video Calls
15.1. If you book a Video Call with a seller, the seller will charge you a fee for the Video Call, for the duration set by that seller. The fee for participating in, and the duration of, the Video Call will be displayed to you when you select the Video Call on the Platform.
15.2. Any Video Call will have a set start time and end time, as determined by the seller and displayed to you on the Platform. If you purchase a Video Call, your access to the Video Call will end at the end time set by the seller.
15.3. Any recordings of Video Calls that we make are used to review the Video Calls to ensure compliance with our Terms of Use, including our Acceptable Use Policy, and we do not make such recordings available to view through the Platform. Once your Video Call ends, you will no longer be able to access or re-watch any part of the Video Call.
Part 2: Goods and Services Tax (“GST”)
16.1. This Section 16 applies to the extent that GST applies to a supply made under these Terms for Buyers. Any words capitalised in this Section have the meaning given to those words in the Australian A New Tax System (Goods and Services Tax) Act 1999 (Cth).
- (a) Except under this Section, the consideration (the amount paid with respect to the Paid Features) for a Supply made under or in connection with this document does not include GST.
- (b) If a Supply made under or in connection with this document is a Taxable Supply, then at or before the time any part of the consideration for the Supply is payable: (i) the Recipient must pay the entity that makes the supply (“Supplier”) an amount equal to the total GST for the Supply, in addition to and in the same manner as the consideration otherwise payable under this document for that Supply; and (ii) the Supplier must give the Recipient a Tax Invoice for the Supply.
- (c) The Recipient is not required to pay GST unless they are given a Tax Invoice for the Supply.
- (d) For clarity, the GST payable under Section 16.1(b) is correspondingly increased or decreased by any subsequent adjustment to the amount of GST for the Supply for which the Supplier is liable, however caused.
- (e) Where a Supply made under or in connection with this document is a Taxable Supply that satisfies the requirements of section 156-5 GST Act (“Progressive or Periodic Supply”), Section 16.1(b) applies to each component of the Progressive or Periodic Supply as if it were a separate Supply.
16.2. You acknowledge that if you are a seller and make a Supply under or in connection with this document, it is your responsibility to seek your own advice on the taxation treatment of that Supply, and to register for GST and/or remit GST.
Part 2: Cancellation
17.1. We hope that you enjoy any Content and Paid Features that you purchase through the Platform. All Content available through the Platform is created by sellers. Sellers (and not us) are therefore responsible for ensuring that any Content provided through the Paid Features is of a reasonable standard and quality and matches any descriptions they provide to you through the Platform.
17.2. If you change your mind about a purchase you have made on the Platform, or are unhappy with the Content provided through the Paid Features, you may be able to cancel your purchase and receive a full or partial refund of the Purchase Price you have paid. Please see our Refunds and Disputes Policy for further details. This does not affect your rights under the applicable law of the country in which you are resident.
Part 2: Ending your Buyer Account
18.1. If at any time you feel that you no longer agree with these Terms for Buyers or any changes made to the Terms for Buyers, the Buyer Features or the Platform, you must immediately stop using the Buyer Features and close your Buyer Account. You can do this by contacting us at privacy@linkpay.co. If you delete your account, your agreement with us in relation to the Platform will be terminated.
18.2. If we end your use of the Platform as described in our Terms of Use:
- your access to the Buyer Features and Paid Features that you have purchased will also end;
- we will not refund you any Purchase Price, unless we end your use of the Platform because we are withdrawing the Platform; and
- your agreement with us with respect to the Platform will be terminated.
18.3. We recommend that you keep a copy of any information or content that you upload to the Platform, as we will not offer you compensation for any losses you might suffer if you lose your rights to access and use the Platform or any such information or content.
18.4. The termination of your use of the Platform or any agreement with us shall not affect any of your obligations to pay any sums due to us.
18.5. Nothing in this Section 18 affects any legal rights you may have under the law of the country in which you are resident.
Part 2: Disputes and Content Moderation
19.1. If you have a dispute with a seller, you can contact us at support@linkpay.co and we will do our best to mediate that dispute. This does not affect your rights under the applicable law of the country in which you are resident.
19.2. If you believe that any Content is illegal or violates our Acceptable Use Policy, you can report the Content, and we will review it, as set out in Content Moderation, Reporting and Removal.
Part 2: Changes to the Documents
20.1. We may revise these Terms for Buyers from time to time but the most current version will always be on this page on the Platform.
20.2. Changes will usually occur because of new features being added to the Platform, changes in the law or where we need to clarify our position on something.
20.3. Normally, we will try to give you some warning before the new terms become effective. However, sometimes changes will need to be made immediately and if this happens we will not be able to provide you with any notice.
20.4. If we make any change or revision to these Terms for Buyers that is detrimental to you and you do not agree with that change, you may terminate your agreement with us in accordance with Section 18.1 above.
Part 2: Law
These Terms for Buyers form part of our Terms of Use and are governed by the law of the country you are in. The courts of that country will have non-exclusive jurisdiction over any dispute arising from or related to your use of the Platform.
