Overview
This Privacy Notice describes how Boink Technologies, Inc., a Delaware corporation (“LinkPay,” “we,” “us”) handles personal information when you use LinkPay as a buyer, seller, or co-creator. By using LinkPay you agree to the practices described here.
Questions about anything in this policy can go to privacy@linkpay.co.
Information we collect
Information you provide
- Account details — phone number, email address, and, for sellers, login credentials.
- Identity verification — for anyone who receives payouts. You may be asked for your name, date of birth, address, phone number, email address, government identification number, images of a government-issued identification document, and a selfie, from which biometric data such as a scan of facial geometry is produced. This is collected by our identity-verification provider, Persona Identities, Inc. (“Persona”), and the biometric data is held by Persona rather than by us. See “Biometric data” below. Verification also includes a review of public sex offender registries where one exists in the country you verify from; see “Sex offender registry review” below.
- Tax information — the answers needed for a W-9, W-8BEN or W-8BEN-E. See “Tax documents” below, because this one works differently from the rest.
- Payout details — the information needed to send you funds.
- Content and profile — content you upload to your vault and the public profile you choose to display.
- Support communications — messages you send us at support@linkpay.co.
Information collected automatically
- Usage and device data — IP address, device and browser information, and how you interact with the platform.
- Cookies and similar technologies — used to keep you signed in, remember preferences, and measure and improve the service.
Information from third parties
Our payment provider tells us whether a payment succeeded. We do not store full payment card numbers. A card number goes from your browser directly to our payment provider; we keep only a reference the provider gives us — useless without our own merchant credentials — plus the card brand, last four digits and expiry.
From Persona we receive the result of a verification, the information extracted from the identity document (such as name, date of birth and issuing country), and the selfie image. We do not receive the biometric identifier Persona generates from it. We also receive the result of the sex offender registry review described below.
A buyer’s phone number or email is their account
If you buy through LinkPay, the phone number or email address you enter at checkout is not just contact information — it identifies your account, and it is how you sign back in. Two consequences worth stating plainly:
- Anyone who can receive messages at that identifier can sign in as you and see what you purchased, along with the last four digits and expiry of any saved card.
- If you give up that phone number or email address, contact us at support@linkpay.co so we can detach it, rather than leaving it attached for whoever holds it next.
See Terms for Buyers.
Tax documents and our tax-form provider
Tax forms are handled differently from everything else here, deliberately.
Your form is prepared, signed and stored by NextForm, our tax-form provider — not by us. What comes back into LinkPay is only a record that you filed, which form, when, and a reference we can use to retrieve the document. Your taxpayer identification number is never stored by LinkPay. That is the entire reason a provider is involved.
That provider account is shared with Slushy, which is operated by the same company as LinkPay. Filings are namespaced so the two products’ records are distinguishable at the provider. We are telling you this because it means a filing you make through LinkPay sits in an account that also serves another product of ours.
How we use information
- to operate payment links, deliver purchased content, and process payouts;
- to verify identity and age, to review public sex offender registries where applicable, and to prevent fraud and abuse;
- to moderate content and enforce our Terms and the Acceptable Use Policy;
- to provide support and communicate with you about your account;
- to send the one-time codes that sign you in, and receipts for what you buy;
- to measure, secure, and improve the platform;
- to comply with legal, tax, and regulatory obligations.
We do not use your content to train machine-learning models.
Public information
A seller’s profile — handle, display name, bio, avatar, banner, and any gallery or preview content — is public, and is indexed by search engines. Payment link pages are not indexed, but anyone holding a link can open it and see whatever the seller marked as a preview.
Buyers have no public profile.
Do not put anything in a public profile that you do not want to be public and findable. A seller can make their profile non-public at any time.
Biometric data
Verifying a seller involves facial recognition. Persona uses a combination of machine-learning tools and optical scans to authenticate your identity document, and facial-recognition technology to produce a unique biometric identifier based on facial geometry. That identifier is used to compare your selfie against the photograph on the document and to judge how likely it is that the two are a match.
LinkPay does not receive the biometric identifier. It is generated and held by Persona, and it is held until we tell Persona that it is no longer needed for the purpose described here and must be destroyed. Persona processes this information on our behalf and strictly in accordance with our contract with them. What reaches LinkPay is the selfie image, the information extracted from the identity document, and the result of the check. Persona sets out its own practices in its Processor Privacy Policy.
We ask for your consent before any of it is collected, and you can decline — you simply cannot sell on LinkPay without verifying, because that is what selling is gated on.
Your verification selfie may be shown to a trained LinkPay reviewer, for one purpose: to confirm that the person appearing in content sold through an account is the person who verified it. This is how we enforce our own rules on consent and on who may appear in content. A reviewer is shown the selfie alone — never your identity document, your name, or your date of birth — and every time one is opened we record who opened it.
We do not use, disclose or retain biometric data for any other commercial purpose, we do not sell it, and we do not use it to identify you anywhere other than on LinkPay.
Sex offender registry review
Anyone who completes identity verification on LinkPay is reviewed against a public sex offender registry or similar database in the country they verified from, to the extent one exists and is public. That means sellers, and it also means co-creators, who are verified because they appear in content rather than because they earn from it. The purpose is narrow: to confirm that the person is not currently listed and has not previously been listed. Where no such register exists, or where it is not public, no review is carried out.
We are telling you about this because it is a search about you against a public register, and that is something you should know is happening rather than discover. What we keep is the fact that the review was run, when, and its outcome. We do not publish it, we do not share it with buyers or with a seller who added you as a co-creator, and we do not use it for anything other than deciding whether you may sell on LinkPay or appear in what is sold there.
Data retention
We keep personal information for as long as needed to provide the service and for legitimate business and legal purposes. Some records outlive an account: transaction, ledger, tax and verification records may be kept as required by financial and regulatory rules, and records of moderation decisions and reports are kept so that repeat behaviour can be recognised.
Security
We use administrative, technical, and physical safeguards to protect personal information. No system is perfectly secure, so we cannot guarantee absolute security. Keep your credentials — or, if you are a buyer, access to the phone number or email address that identifies you — confidential, and notify us of any suspected unauthorized access.
Your choices and rights
Depending on where you live, you may have rights to access, correct, delete, or export your personal information, or to object to certain processing. Sellers can manage some information in account settings; buyers, who have no settings page by design, should email privacy@linkpay.co. We will respond consistent with applicable law.
You can opt out of text messages by replying STOP — but note that sign-in codes are sent the same way, so opting out means signing in with an email address instead. See Terms for Buyers.
Minors
LinkPay is for adults only. The platform is not directed to anyone under 18, and we do not knowingly collect personal information from minors. If you believe a minor has used LinkPay, or appears in content on it, contact us at support@linkpay.co immediately.
International transfers
We may process and store information in countries other than where you live. Where required, we use appropriate safeguards for such transfers.
Changes to this policy
We may update this Privacy Notice from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you.
